Welcome and good morning. You're listening to a lot of law on your host, Tony Kyle Wyatt, while you're on associates, located at 2847, South Ingram Hill Road, you didn't see 101, Springfield Mo, Open Monday through Friday, handling all of your family law, and personal injury needs. You know, sometimes it's hard to find topics and sometimes it's quite easy. And this one, maybe it says, dealing with core process, criminal case, all the good stuff. Of course, we're talking about Lindsey Clancy. And, you know, a lot of speculation, a lot of talk has been had about this lone juror who was able to fight off 11 of his compatriots, nine of them being women. I'll listen to three of them here in a little bit. But,

you have heard of the term of jury nullification. We've seen those all the time, and not all the time. But they're not that uncommon. Where jury hears set a facts throughout the day of a trial. And, in the facts point to one conclusion and one conclusion only, that the defendant is guilty. But, to the jury, to a person, they just feel like it's not fair. You know, based on whatever, you know, the most common one that comes about. Is you have a murder trial or a manslaughter trial. And, a father is being held on a trial for killing the assailant of his dead daughter. Right? You got raped and murdered and all this horrible stuff. And, the guy had a trial, and he was set free, based on a technicality, and the father loses his mind and kills him.

In Jury's list of the facts, I mean, they got you dead to rights, but hell, I'd have done the same thing. And so they do jury nullification. Where the jury says, you know what, we're not going to find you guilty. You're free. That's the best strategy, isn't a fence attorney to roll the dice. We're going to go for jury nullification. It doesn't happen that often. But, I mean, it has happened. What we've seen this past week, I would argue, is a reverse, or the, or the adverse side of jury nullification. It's where the facts, supposedly, again, a lot of us don't know all the details. But, suggests, the facts suggest, that under Massachusetts law, and again, that's the thing you have to differentiate. You know, Massachusetts law, and Missouri law, it's quite different. All right. In regards to culpability based on mental defect, all that stuff. It's quite different than what Missouri law has. But, under Massachusetts law,

which the jury were sworn to uphold, perhaps, and again, I don't know this for a fact, but at least 11 of those people thought so, that she was not guilty by reason of mental defect of some sort. But, you had that one lone juror. It would be, what was the senator's name out of, you remember, he goes, this is my Spartacist moment, for the booker. Yes. Cory Booker. In actuality for this jury, it really probably was his Spartacist moment. Because, he stood up and said, I don't care if the law states that I post to let her free. We have three dead babies, three children that are deceased, due to the conduct of Lindsey Clancy. And you're going to tell me, well, under Massachusetts law, she didn't understand what she'd do. So, we got to let her go. He said, no, hell with that.

And he held true. What was it? Five days of jury deliberation. Five days. You know, the judge will play a quick snippet of that. When the judge declared a mistrial, he compared what happened in the jury room to World War II, where you had the UK, who was fighting by themselves against Nazi Germany. So, that's the way I looked at it as, this lone juror, the judge didn't come out and say it. Obviously. But his lone juror, great Britain, fighting back, pushing back all by himself against 11 Nazis, people who wanted to let this lady walk. Here's the judge declared the judge. I remember the jury. At this point, I'm going to declare that the jury is deadlocked, and I'm going to declare a mistrial.

All right. I just wanted to make a comment. And it, I'm kind of a history buff. And during World War II, Winston Churchill was the prime minister for England. When England pretty much stood against Nazi Germany alone. And so Churchill, oftentimes, had to talk to the citizens and say, let us brace for our duties. And I always liked that phrase. And I thought of that phrase when all of you were agreeing to be on this jury. Are you agreeing to brace for that? So brace for this duty. Brace for this duty. And it's lone juror. Well, I think you're right. No, it's a man who fought back. The pressure he had to endure those those five days. Those of you who have served in jury,

Nick, have you ever got to join to go being a jury yet? I did, but I was like cut immediately. Or I don't think I even had to go down there. I remember one of those, like, called the number right. And so I didn't even cut. Yeah, so that's it. It's not spectacular. The jury room. There is nothing in there. You are, you're in this room. Four walls. Maybe, maybe, like, you have a window look out of. But there's nothing to do. I don't believe there's no books. There's no magazines of flip through. I mean, you're sitting there at this large table, this large desk. And then usually either in this room or in a, in a adjacent room, you'll have the evidence of physical evidence that jurors can get permission to go walk, look at examine, what not. They can look at, they can request transcripts from the trial, you know, from certain witnesses. But they're in this room. And, and, and, and they,

lots of times when the jury is released, they'll immediately go ahead and vote. You know, just to see where we're all at, right? Let's, let's listen, you know, they'll go cut to the chase, you know, we can, we can skip dinner and, and head home. And, and so, you know, they'll, they'll, they'll do a quick silent vote, right? You'll, right, on a piece of paper, you know, guilty, not guilty. And then the four men, four person, we'll, we'll tallied up. And then say, you know, or a 10-2, or so we got two people that says not guilty. And, and so, who knows how long that process went, you know, was it always just this one guy by himself? Was there more people who then work events? Oh, I guess we'll let this mom go, strangled her children to death. Um, but nonetheless, he held, he held firm. And the amount of pressure he had to receive. Because you got people who want to go home, they got lives, they got jobs to go to. Um, and, and, and, and, and no telling what kind of, uh, uh, arguments were, were, were, were having had in there.

What upset the jurors that you, you, you'll hear for them, I guess when we come back for the break. These women jurors were upset because the, the lone juror, the Spartacus, in the case, well, I, I might have some reasonable doubt. But I cannot, in good conscience, let this woman walk, let this woman be able to go scot-free to kill your kids. Despite what the governor of Massachusetts did, just what was it last month or, or there about, we're saying, you know, we, uh, under Massachusetts law now, you can abort, you kill your baby up until the time of birth. Up until the time of birth. Now, those of you who have had children, uh, nine months is pretty far along. Eight months, pretty far along. I mean, they're just not, and you know, I was thinking of coming up here to the, to the station on that, I was just thinking of the gruesiveness of the abortion. How is it that they don't have the ability to be, how is it that they don't, do they offer, like, kind of, painkillers or numbing for the baby before they kill, or do they just start ripping off body parts of the child?

I, maybe we could get an expert in here on abortions and, and, and, you know, educate us, you know, no, no, no, no, this, this point, natural for the baby to be, have his arm pulled off. I mean, it just, I'm curious what, you know, the, the, the left always talks about how, how compassionate they are, you know, sensitive they are. all right So under mass chooses Mass use does not give a mental disease or defect a statutory definition is a legal term of art the jury applies under the commonwealth There's a mccoll the 1967 case so what the law actually says a person is not criminally responsible You're at the time of the conduct because of mental disease or defect she lacked substantial capacity Either to appreciate the criminality or rungfulness of the conduct Took a form her conduct to the requirements of the law Either prong is enough substantial does that mean total incapacity appreciate is broader than no wrongful nith wrongfulness is moral criminality is legal the commonwealth can Defeat that prong by proving substantial capacity to either What mental disease or defect means it does not? Official homicide It's a legal term not a medical one. It need not match a DSM or other formal diagnosis

The jury decides from all the evidence whether the defendant had one at the time of the offense It does not include an abnormally characterized only by repeated criminal or anti-social conduct judges are not required to find the phrase further The sgc, which is a jury instruction has said that the subject is too complex for a mandatory formula Not enough by themselves voluntary intoxication And alcohol or drugs that's not enough drug addiction or alcoholism standing alone is not enough anger jealousy frustration not enough Personality character disorder that is only repeated anti-social conduct What can still qualify psychosis and you probably heard that work quite a bit during the trial including postpartum psychosis bipolar with Psychotic features schizophrenia spectrum illness and similar conditions and the jury finds they are a mental disease or defect and they cause the McCold in capacity Lassing drug induced mental disease cocaine induced paranoid psychosis that is not limited to being high

That could also be one late in illness activated or existing illness Intestify by voluntary intoxication unless the defendant knew or had reason to know the substance would have had that effect I mean if you you know, yes, you got a allergic reaction or something you could be you know found I guilty about that how the burden works is once the defense is raised which linsey clancy defense did the commonwealth must prove beyond a reasonable doubt either no mental disease or defect at the time or even with one She still has substantial capacity both to appreciate wrongfulness criminality and to go form her conduct Here is one of the commonwealth's Expert witnesses talking to that effect now doctor. Did you form an opinion to a reasonable degree of psychological certainty as to whether or not The defendant was suffering from a mental disease or defect at the time she killed her children. I did And what is that opinion that opinion is yes she was she was experiencing bipolar to disorder depressive symptoms and there were other things that were

exacerbating that making it worse one is the the sleep problems and Probably the continued adverse reactions to medication and so on but yes in my opinion she did have a mental disease or defect on January 24th And doctor to a reasonable degree of psychological certainty did you form an opinion as to whether or not the defendant Appreciated the criminality or wrongfulness of her conduct when she killed her children I did yes, and I'm at the end of my report. I was very careful about how I phrased this and so sustained if you could just answer the the question Regarding your opinion so yes you formed an opinion. I did yes, and what is that opinion? That opinion is that she retained an awareness of the illegality of killing others including killing her children Her moral awareness of the wrongfulness that this killing was influenced by her strong desire to die And if she were dead

Not to leave her children behind Some of this perception was realistic for example my children will suffer without me because they would have suffered I think and some of it was distorted For example nobody else can care for my children But her awareness of the illegality and moral wrongfulness of such killing is best appraised by understanding these acts as a serious Suicide attempt combined with how to rustic fill aside killing her children out of love rather than as a response to command hallucinations And did you form an opinion to a reasonable degree of psychological certainty as to whether Miss Clancy was able to conform her conduct to the requirements of the law when she killed her children. Yes, and what is that opinion? That her capacity to conform a conduct to the requirements of the law is again best understood by considering the seriousness Of her suicide attempt and her strong desire not to leave her children

She demonstrated such self-control throughout the day on January 24th And her actions between 515 and 6pm that afternoon were influenced by her depression and her hopelessness about her life And the desire to end the pain she had experienced since October Although this depression and hopelessness influenced her decisions She retained control over weather When and how she carried it out And the inclusion of her children All right, I think you got there. And so this is what the jury got here You know another Prong Supported the the commonwealth's argument is that it was reported by like it's Lindsay Clancy herself That when she was strangling each child she was Telling them to go with God to be with God

Knowing that they were innocent right that this was you know that Zach was going to end their lives You know and a couple that with or design, you know sitting her husband off To run errands just long enough Just long enough for her to complete these gruesome murders You know have you noticed how many these these these blue hairs have been going up against dad the husband I have been hearing how how horrible the human being he was And how many of them thought that he's one who really did it that somehow She's taking the blame for this and what her own attorney has reported Um, and this was it was came out after afterwards is that the husband He described months long decline after Kalins birth, which was the I think the youngest born in 22 anxiety and samia including 48 hours of sleep weight loss suicidal talk Then what he called a big spiral after Sarah Quell in early December he went with her to appointments

At a December 6th visit he allegedly told providers the meds had made her 10,000 times worse And asked if they could stop everything and start over dosage was increased instead After she disclosed intrusive thoughts about harming the kids he asked whether she needed to be kept away from them She said no he didn't ask her parents to stay and push harder for care He left his job and worked from home. He went on He went on paternity leave To be with her on New Year's E 22 after a second ER trip He said he was exhausted and told her it was time for McLean They had no diagnosis and he had hoped the hospital would figure out a path He visited her there. He testified He later told her she had to go After McLean discharged January 5th of 23 he said he checked on her every day The morning of January 24th he thought she was having one of her best days Snowman with the kids he left on her request for chorus medicine and take out No clinician he said ever told him she should not be alone with the children

I did not know what psychosis was until after this happened He later filed a wrongful death malpractice suit against treating providers Legendally failed to diagnose monitor and respond as she worsened The issue again Is what punishment is It's appropriate for for these three children and here's the here's the other thing too to keep in mind I hear this a lot Men in similar situation What has been the outcome for those cases And in cases of killing your kid And the results are going to be quite different than what we saw with Lindsey Clancy There have been unfortunately numerous actions recent actions of

Husmin who have killed their child after death and All of them And this is what what's going to weird you know the women always want to be treated. Oh we were the same We we we got you know we we need to To be treated all the same but then on this issue for whatever reason hormones And drugs is a difference And what we have is when fathers Who have killed their their children have have have a full trial And then there are found guilty and what's sitting to death And so you had this all over the over the world of these paternal Filisides of the convictions of prison and so fathers who kill a child what courts usually do Most paternal filisides conviction in prison Motive is more framed as revenge abused We're familiar side than an acute psychosis Ontario 298 cases

Fathers more likely than mothers to be convicted convicted to murder sent to prison and given longer terms Uh I turkish forensic series of every father found fully responsible. Only mothers got in CR or partial responsibility Uh Matthew Schlier out of Iowa in 2026 strangled his five-year-old child had a bench trial in in gri hospital no prison NSW father 2019 stabbed his five-year-old Uh Believing the child was the devil Uh Sam Nelson back in 1977 it killed six children after wife said divorce Insanity was rejected and he was convicted And so you have these cases over and over where these men somehow get convicted But if you're a woman for whatever reason you get the defense and you get what is it a million dollars Has been raised down to go fund me for for Lindsey Clancy It's not like she's profited pretty well from this But we got to take a break here you are listening to a well All right

You know I was looking over the break The other men who have killed their children In the last 12-day team months, which is I mean this is just sick right goes on Jeffrey Spear from uh port Huron, Michigan So September 11th, 2025 shot and killed 17-year-old son shot 13 and 12-year-old Plan murder suicide fear jail Uh entered a guilty plea without parole Sentence June 29th of this year Levi Higgins green out of Oregon set to 25 stab nine-year-old with a spear Years of household abuse please the second-degree murder assault life with 25-year minimum Scott Gardner out of Florida June 2025 left 18 month old in a hot truck three hours while at a bar Consuming alcohol Please no contest the second-degree murder aggravated child abuse 42 years Fernando or Fernandez-Fruin out of Lakewood, Washington shook two-month-old

Five minutes because the baby would not stop crying guilty plea to murder 34 years Jake Harrow out of Riverside, California murdered a seventh-month-oldy manual fake kidnapped the story guilty plea to murder 25 to life um is just easy I guess to convict the dad Of killing your kid but god forbid of the mom day and so here is the the women three of women jurors Who it almost sounded like a episode of the view Pure to get to meet with these uh, well, I mean I could imagine being stuck in the room five days with these ladies Uh, but they're just they're just a gas to have what this long juror was was was doing to go listen He was very arrogant He really did not Take anything that anybody said The nurses he he tried to ask a question about The medications and we went back to The report from social hospital. We had the toxicology report. We could see exactly the amounts

The nurses in their room spoke to that and There were nurses on the jury yes spoke to that that specific thing that was a question that he had And he just completely disregarded the information that they gave me and he had reasonable doubt He admitted he had reasonable doubt after we watched that video of the interview. I think that's what it was He admitted he had reasonable doubt and I started filling out the forms. I was so excited I actually do with three forms. I had a fill out And I started filling the mouth. I wrote my signature on each one and then he said But I'm still not gonna say that she's not guilty by reason of incident. I'm not sure if rogue is the right word to but Every one of us in the hours of a frustration would get up and walk the room Because you just couldn't sit anymore and would all go to the cart the the exhibits

He I think got up to the cart once very briefly and went back to a seat he would not He would not interact with us and and Try to understand we read to him on numerous occasions the definition of a reasonable doubt From Judge Sullivan's instruction. He actually said one day in the end Why don't we have the judge come in and read it again and we were like no we have it in front of us We don't need that and we would highlight it and You know so and so this is the definition of reason of doubt But he at the hardest time getting off the fact that Lindsey Visually killed our children and we had no problem with it I know we get cut off there. That's that was her next line of thought We were fine with it. So what's gonna happen now? um The state hasn't I made any announcements, but

There is a hearing coming up later this month st. 29th at 9 a.m Status conference and that is where the the state will announce What their plans are what the state is doing now as murder charges remain hung jury is not in acquittal She stays held without bail at tukesbury hospital So forensics psychiatric institution prior bail order stated effect Paralyze not going home Cruises public line is still justice for kora d'Ason and calen and if the evidence shows she was in control He did not say he was dropping it What crews can do only he can pick is you know the elected prosecutor Retry first degree murder on a new jury Defense counsel ready ten and lawyers who know crews so that is the default for this DA Judge Sullivan talked about retrying sooner rather than later Reddington also said a second trial could be six months to a year because the publicity and jury selection double Jeopardy does not bar retrial after a true hung jury

Now he could reduce the charge second degree murder romance slaughter and retry or plead plea in cr style civil commitment path or a homicide plea that is not first degree life without parole um Or you can dismiss it only prosecute uh Hopefully god he does not do that You know The evidence also you know that would have pointed to With just the the the the the the the the planning of it all And you know i i tell us a lot times i and unfortunately in my line of work i deal with children who get abused unfortunately And you see the the the pictures the images of the injuries of Of a child i have a case where child was three maybe four years old and The mother was freed the child after father's weekend visitation and Child what to i think was dropped off at daycare so mom didn't get her hands on the child yet

They did exchange the daycare and a daycare daycare workers one who reported it and the child kept picking at his at his butt You know kept squirming in the chair and and so when she went to the help him She you know she pulled his pants down and and the bruising on the boys but That guy is still being charged he's still facing charges in krisch county He has not taken responsibility for what he's done in fact What he wants to do is well i bet it's a stepdad I think it's a stepdad of mine don't it you know even though there was no Time for any of that to happen but that that's the defense are going on and would you believe it to this guy He's still he's he's trying to get custody back he wants to get his visitation unsupervised to say i'm a good dad You heard that uh that closing argument from lindsay's attorney Well, she's uh she was a good wife and a good mom i go well, you know most good moms generally don't strangle their kids to death That would not be my definition of a good mom

I'm welcome to be wrong on that But this happens far too often and and and and and and people just want to the the push it under the rug And so when i remind prosecutors because i'm not a part of the case i go if you think about giving this gentleman a pleadial That avoids jail avoid prison you need to look back at that picture and ask is this justice for for for the injuries caused And i think that's what the the the the lone juror the Spartacus struggled with Is how can i and he maybe he's a father himself in good conscience Hello, these three beautiful children What was ages five three and eight month eight month old child can you imagine And allow their attacker To be let go Because she had a momentary and oh, oh, yes So one of the the the facts that came out of the case and i think again if i was that juror

I would hope i would have had the The tenacity be able to stand up against the pressure Guarantee he felt in that room when you got a love to other people staring at you um She talked about there was a voice in her head a male voice in her head Uh telling her to do it And the evidence of the came out is Um the after she did it she never heard the voice again. Oh, the voice is gone It is just there seems awfully kibing it I mean if i i want to you know i have a voice i i i like to be able to hear it more often than just the one time I'm actually killing my kids And that's what just makes it hard To just to say the ad you know what this this this poor woman is old bubble god bless her You know Musgrave family fun appearance mic and paulum Uh organizes brandy mulligan a tiktok not a relative beneficiary is named as a musgrave's go fund me verified page So they got money directly Reddleton is aware go fund me rules by bar earmarking it as her legal fees organizers raise goal from two million to three million

The day of the mistrial So mid august 2026 the first days of the trial they raised 830 to 850 thousand dollars August 21st across to one million dollar threshold September 4th through 5th the mistrial weekend Rose to 1.1 to 1.16 million and then on september 8th by noon More than 1.2 million dollars has been raised 35,000 35,000 donors To get this poor woman That's our society you guys we have to get our last break of the hour you're listening to all alone So this week for the first time I think ever they've had a midterm rnc midterm convention Highlighting some of the battleground campaigns elections that are going around the country campaigns elections that are going around the country President trump

christian appeared on wednesday and uh and you know he had a you know he's always got some good stuff He is never a lack of material With with president trump But he really was giving it to the opponent uh the compaction out of texas you know compaction dethrone the uh the current senator their cordon is it john cordon is that right? John is correct and um defeated him but despite the millions and millions of dollars that john thrune who i got i wonder how why is it i have You know figured this out how is it that we keep getting these majority leaders that are feckless And and you know i mean Mitch McConnell he the only great thing i ever said i gave him total credit for is how many judges He pushed through under trump first administration this john through and i didn't seem to do anything the linos

Think so lead leaders in name only Linos like that Yeah, and then and so it's just it's just frustrating Is absolutely frustrating to the sea and so hopefully i'd like to see him just go away You know i would like to see either you know a uh uh You know tech ruse obviously Is a very strong leader i think he has different aspirations in 28 Mike Lee out of you tall i think would would be i mean i think there's a hint there's there quite a few people there They could they could actually because this save america act I don't know how we're not getting a pass we you know if you want to win elections How about take the cheat out of it and we might say in a better chance But anyway here's president trump wins denied He's sticking it to uh talariko uh this uh the james talariko on a texas he described himself as a person who hates Christianity says that god is transgender he called the american flag a complicated symbol of hate claimed that the ten commandments are a form of fascism and when he was asked what he loved most in the world

He said i love trans gender children which uh He was also somebody that hated eating meat But he ran a campaign to beat meat he called it beat meat i don't know what the hell he meant by that These people are gonna tell me what the hell does he wants to beat meat But it was bad for his image so he started eating meat And he recently he's getting worse i'm getting myself in trouble getting worse but he was recently seen having a barbecue and eating a lot of meat But that's what happened he ate it and then

He was seen running backstage to a room and throwing up all over the place He doesn't like meat He also loved wearing masks and he was seen wearing a mask as the short number of months ago Any guy in texas that's wearing a mask a few months ago This is not gonna be your senator it's not gonna work out Not gonna So getting free to loving pictures So James Salarico And everything that that president Trump Discussed with actually factually true which which is just so weird you're running to be the senator There's only two of them in each state and you're gonna represent the lone star state and You know when you think of texas I don't know I I think of you know being tough you know cowboys You know being a viral individual

Maybe a little bit a dash of toxic masculinity whatever that is But then you see a guy like James Salarico which what was the uh the guy Beto or or remember that These are the democrats they keep throwing these guys out That are horrible horrible candidates. I mean Beto or or granted Ted Cruz And that was gonna be there there there there we're gonna take over Texas. We're gonna get him with Beto That then we're cow. What you know I I think texas to democrats is fools gold You know they keep thinking that we you know for a long time you know you think like Pennsylvania The republicans fools gold we keep thinking we're gonna we're gonna take Pennsylvania or even Virginia You know Virginia we thought we had a chance there when they elected a republican governor sometime ago But then you know that didn't always work out so But texas is something they're doing so now they're doing damage control because now you're in the general Lexi when you're in the primaries you could be a crazy left-wing Moon a tick and you get elected. I mean hell. I think you might be maybe a socialist or a communist and you might win a

Democrat primary But when it's in the general election When it's a general election you got a you got a total gentleman that you got a You got a got a backpack a little bit on some of this. I you know I sing that in the context there You know I really I didn't really I you know I you know they twist thing you know those republicans They just they twist things around So here's James Tallerigo walking back His claims that there are six genders to go listen 2021 hearing you said there are six biological sexes Do you still believe that standing here right now? No I've missed the mark on some of my past statements. I will be the first to admit it What I meant is that there are two sexes and then there's a small percentage of people with genetic abnormalities Obviously didn't say it correctly. There are not six sexes. There are two and and I think the reason that politicians in that convention center across the street want to talk about six sexes is because they don't want to talk about six-dollar diesel

Everywhere I go across the state of Texas people are struggling to survive in this economy They're struggling to afford the basics groceries gas utilities health care And that's what I'm be focused on from now until election so just to nail it down here standing with me You can confidently say there are two sexes a man and a woman absolutely No, of course I can you know I wonder if I'm kind of crazy.
