2:05Story here from CBS News, Kevin Reddington, the lawyer for Lindsey Clancy said today, he will ask for the case against his client to be thrown out. After hearing from a number of jurors in the case, Reddington telling CBS mornings he will present a motion to dismiss on September 29th. And now some of the jurors, the 11 jurors, it was 11 to one. Some of the jurors in the 11 are now speaking out. And they gave an interview to, I believe it was the NBC affiliate in Boston. Two of them dead. Yep. Sam, I think we have some of that audio to play. We do. Okay. While you're looking for it, Sam, just real quick, there was nothing that either of those women said that shed any new light on any of this. He's gonna bolt out. He admitted he had reasonable doubt after we watched that video of the interview. I think that's what it was. He admitted he had reasonable doubt. And I started filling out the forms.

3:06I was so excited. I actually, there were three forms I had to fill out. And I started filling them out. I wrote my signature on each one. And then he said, but I'm still not gonna say that she's now guilty by reason of insanity. He would not interact with us and try to understand. We read to him on numerous occasions the definition of a reasonable doubt from Judge Sullivan's instruction. He actually said one day in the end, why don't we have the judge come in and read it again? And we were like, no. We have it in front of us. We don't need that. And we would highlight it. And so and so, this is the definition of a reasonable doubt. But he had the hardest time getting off of the fact that Lindsay viciously killed her children. What? Jesus, Louise, where did you come from?

That sentence alone explains why he was like, no, there has, there has to be some punishment here. Do you buy the argument that some have positive that he was a rogue juror, a stealth juror? Somebody who tells the lawyers what they want to hear so they can get onto a case with an already preconceived verdict. I don't think there is ever going to be an acceptable resolution to this case. I don't. Huh. Okay. I don't care where they try it. I don't. You would not want to be on that jury. You would not want to be on that jury. No, I would not. I don't want to be on any jury. Ever. But if you had to list the cases that you don't want to participate in, this would not be

5:08one. This would be at the front and center. You do not want on this jury. There's chatter online that this juror had a calcium bed. There's no confirmation of that. I want to make that very clear. Oh my gosh. Very clear that there is no confirmation of that, but there is chatter online that he had to have some calcium bed. And that's why he held out. They're also taking the stance of, of course, one man had to come in and try to steal the rights from a woman. But what if that one man truly believes there, there has to be something, something has to be done or we are all going to live in a world where quote somebody snaps and we just go, well, and we've already seen that in one case and it's happening right now in Chicago. So although I believe that mom's been, she's been charged. Well, so is Lindsey Clancy. But he had the hardest time getting off the fact that Lindsey viciously killed her children. I hear what she said and I think I hear what she's trying to say and she doesn't word it

6:11properly because they both, now I did learn a couple of things from this interview. Number one, they were so convinced that he was going to come off the fence, so to speak, that the four woman had already written up verdict sheets three different times and sign them. You also learn in this interview that the verdict was going to be if he did come off the fence, it was not going to be a straight up acquittal. It was not guilty by reason of insanity. I think God, there's some, you know, semblance of reasonableness there. That he held out. How many people Sam, honestly, and I talked to a buddy of mine about this a couple days ago, he was the holdout on a jury in Kansas City. And he just said, you would not wish that on anyone. Pressure. My friend was the holdout. And in that case, this should make none of us feel good about the system under which we operate. He said, I understood the law.

9:15I understood the burden of proof and what the law says about it. And the prosecutor did not meet that burden of proof period. So everybody else was for guilt. Everybody else was for guilty. And when you looked at the law, they just didn't have the goods on this guy. He said it got to the point where people in that jury room here in town in Kansas City. We're saying things like, look, you know that even if he's not in the court, he's not he didn't do this. There's something else he has in his background. Would you want to live next to this guy? What was his a murder? It was not. Okay. Drug or weapons related. And he said, are you listening to the, he goes, are you listening to the words coming out of your mouth? Well, they maybe didn't prove it in this case, but you know he's got something in his background. Something else. Right. Like, I'm going to sleep just fine at night because I don't think this is a good guy. Well, he said, like, that might be the case. That's not what we're here discussing. And you guys make fun of me because I can't stand the jury system in the United States.

10:18I think it's wrong. I think it's the best that we have. I think a lot of the system is incredibly flawed. I'm sure he's one of them. I would not, if I was accused of a crime, that I did not commit and I knew I didn't commit it. The last thing I would want to do is entrust 12 people. I don't even know. Yeah. It was my future that say things like, you know, he's probably got something in his background. How many times do you think it's been said in a jury room? Listen, 11 of us think he did it. Yeah. You're the only one who thinks he didn't just come over and let's go home. I don't want to spend another eight hours tomorrow sitting in this room, trying to deal with you. Yep. And how many of us would buckle under that? I'd like you're being bullied. I'd like to think I would not. I'd like to think it. But then what I'd be called a rogue juror for doing that, a stealth juror because I truly believed in this person's innocence or guilt.

11:21And now I'm a rogue juror. Maybe you're wrong. Maybe the 11 of you are wrong. You know, I always say that two things can be true at the same time. Like in almost every scenario, we could, we could use that in the stories that we bring you on Dane and Parks every day. When we come back, we have an update.
