And so criminal. An unprecedented day in the courtroom. What do you want me to do? I want to get a brass band. I read the instruction as written by the S.K.C. What happens next in the Lindsey Clancy case? In sensitive is killing three children. In sensitive is ignoring those facts. We have an obligation to stand up for those people and see justice and make sure that they're authentic at justice and make sure they get justice. Is the judge fumble the trial from the start? Well my point judge simply is that you're kind of glossing over the issue. The issue is this juror will not according to that note. Apply the law of reasonable doubt. Okay, by this point, if you've been following the Lindsey Clancy trial, you know a Miss trial was declared Friday, September 4.

This was after seven days of deliberations from the jury and them saying multiple times that they cannot come up with a unanimous decision on a verdict for Lindsey Clancy. Lindsey Clancy charged with murdering her three children. Dawson, Kora and Callan. So what went down Friday? The main thing that went down Friday was this big emergency stay on the ruling of a Miss trial. After the judge was declaring a Miss trial, Kevin Reddington, the lead defense attorney for Clancy, was like, wait, hold up. No, no, no, no, we're going to file this emergency motion, take this to the Supreme Judicial Court and Massachusetts and we're going to try to keep this trial moving on without declaring a Miss trial because as we heard on Thursday, Kevin Reddington made it clear that based off what he saw from the jury's note, there was one guy, one juror holding out and that was a hold up in what Kevin Reddington believes

was a win for his side. He made it seem like it was 11 jurors saying not guilty by reason of insanity and there was one juror that was not on board with that. At this point, we don't know that. That's just what the narrative is. And Kevin Reddington, the experienced attorney, does a good job of controlling the courtroom and controlling that type of narrative. But he was not good at controlling what happened on Friday. His request to keep the trial moving long denied by the Supreme Judicial Court. He made one more attempt to get Judge Sullivan to keep it going and Judge denied that. So we are at a Miss trial officially. We have declared Miss trial in the Lindsey Clancy case. And now the case starts over. Everything over the last month and a half starts over. Patrick Clancy's Lindsey's ex-husband released this statement via his attorney shortly after the decision.

It said Patrick Clancy is grateful to the court and the jurors for their hard work, their commitment and their perseverance. The loss of Patrick's children is something from which he will never recover. And from which there will never be closure. The prospect of reliving this tragedy through another trial is extraordinarily painful. For Patrick, first family, for all of us. So that statement sounds to me like Patrick is pushing for some type of plea deal or the charges to be dropped altogether. So it doesn't have to really have the trial. It doesn't have to take the stand again. And frankly, the center of so many conspiracy theories. I mean, you have the Patrick Clancy. Did it crowd? And this is this guy's real life. He's not here to be a subject of a TikTok conspiracy. His children, all three were murdered by his wife. So I get where this statement is coming from. I don't know at this point if the prosecution will do a plea deal or something that lets Patrick just move on without having to go through all this again.

So that brings me to what happens next. Well, the next hearing in this case is scheduled for September 29th. And that's a date we'll likely find out when a new trial will occur. A venue for the retrial. If the state goes for it, Plymouth County District Attorney Timothy Cruz said Friday he hasn't made an official decision, but he did say this. Our priority has always been to fight for Korra, for Dawson and for Calon. The noise in this case may be louder than it is for other prosecutors in our county. But we have treated it the same as any other case. Children were murdered. And it's our job to see justice. Now judge Sullivan said in court that he would like to do the trial late fall of this year, if possible. Meanwhile, Kevin Reddington said he would have started the retrial today. You said you were ready to retry this on Monday. Do you still feel like you could turn this around after a later? Yeah, absolutely.

Have you heard something you would do differently with the second trial? Why would I? I won the case. Now, why would Kevin Reddington want that? I'll tell you, he thinks he's the hottest thing right now. He's gotten all this fanfare from the Lindsey Clancy supporters. People wanting to touch him, kiss his cheek. It's so weird. But Reddington's like, yes. Yes. This is just drumming up support for my client for Lindsey Clancy. He even said it. People from all over the world are sending her fan mail, fan mail for a woman that admitted to killing her three children. Summer is fine, but it is not exactly famous for structure. In my end of it, my routine could usually use a little reset. But getting back on track should not require pretending I suddenly stop liking bread. The poor thing is in a wheelchair. As we all know for the rest of her life. And sat there through seven weeks of the trial. We had nobody had anything bad to say about her except for the two. Except for the two prosecutors. And apparently Tim Cruz. This is not about women's health care at this point. That needs to be worked on, revamped. There needs to be more research into postpartum depression psychosis. All of that. No denying that over here on my end.

But Lindsey Clancy does not need fan mail. She does not need fan mail for what she did. She doesn't. But for writing to any's leaning into the supporters hard. So based on the news reports that I've seen, it seems like Judge Sullivan will retain jurisdiction and be the judge again for the retrial. So let's say everything goes to plan. Prosecution goes for a retrial. And as a jury trial again. The defense, I think, benefits here. Because hey, you're looking at the same situation. The burden in Massachusetts in this type of case is on the prosecution. A lot of experts this round said the prosecution did not meet the burden. And that burden is proving that Lindsey Clancy, a woman who strangled her three children to death, was in the right state of mind. She was not going insane.

And I'm not a legal expert, but in my opinion, I don't know how it's possible to prove beyond a reasonable doubt that someone was in their right mind when they murdered somebody. Think about that. Think about all the cases you know people that kill people out of violence, out of, I don't even know what, except out of self-defense when you're not in your right mind. And the reason this case is so odd is, okay, let's say, let's say it's a regular murder. The prosecution, I think, could have easily proven premeditation. They could prove that the planning was there with the evidence that they laid out of sending Patrick away all that stuff. But because of the way affirmative defenses are handled in Massachusetts, the prosecution is required to prove a state of mind rather than a set of facts. And that is a difference. Now, it could be a bench trial. And if it is a bench trial, that's a whole new ballgame. At this point, I think that's the best chance the prosecution has to get a guilty verdict.

No jury on a bench trial. It is just the judge. But the law is still in favor of the defense. So even a judge looking at this. It's the burden being on the prosecution just makes all of this very out of the ordinary. One thing I know, no matter what side of this you're on, I think we can all agree that the jury has to be sequestered at the next trial if it is a jury trial. Everyone was talking about this case, even the president. That trial had a wide study. Well, I'm talking not to. It's on television so much. It's hard not to follow that. Followed it pretty much. But it's a shame. It's a horrible tragedy. It's a horrible tragedy. I see what's happened and it's, it looks like it's a home jury. I think the judge is going to be a mistrial. I assume there's going to be another trial. It's a terrible situation. Look, she did a horrible, horrible thing.

Can't be worse. But you'll find out what the price to pay is there'll be a price. It's going to be mental institution or jail or something. But I guess they're going to go through another trial. It's too bad. And juror holding out or non juror holding out. If I'm the judge, I'm almost saying this is a mistrial because the jury is so tainted. You got a woman arrested for taking pictures of the jury. The jury went home last weekend during deliberations for a whole weekend. Live their lives. You can't tell me they're not going home and somehow seeing something on their phones. Even if it's not on purpose. You get ads. You get notifications on social media. You get a tick-tock thing saying Patrick Clancy guilty. You didn't ask for that. You're like, wait, why is this popping up on my phone? It's just a different age now with social media. I do not know how you can think a jury is not getting any outside noise in a case this big.

A case that's gone outside the courtroom. A case that is apparently gone worldwide with this support for Lindsey Clancy. If you can't tell, I think Judge Sullivan should have sequestered the jury. Maybe it wouldn't have made a difference. But I just don't know how you have a fair trial when tick-tock is involved. But alas, it does seem like the state. Well, once again, try to get justice for Cora Dawson and Callin. That's so criminal.
