Hey there folks, it is Thursday, September 3rd, and Friday, September 4th will be day 7th of deliberations in the Lindsey Clancy Triple Murder Trial. Welcome to this episode of Amy and TJ Robe. It has been a fascinating past couple of hours in this case, ups and downs, twists, turns, yelling, throwing, slamming, confusion.

3:20But the bottom line is this jury ain't done yet. No, and we don't know where they stand. We know that perhaps it's 11 against 1 based on following the judges' instructions, but that does not mean it's necessarily 11 against 1 on a verdict decision. We keep saying that, and people are piecing to the other, but we don't know that. People are piecing it together and making assumptions and what not 11 and 1's being thrown around, and it could very well be. But we don't know and we're not supposed to know. We're not, you're legally not supposed to know and be able to pull what is going on, and Reddington said that. So I caution everybody, and we want to go with that, and you're going with that assumption that you assume is 11 to 1? Well no, it's just that we only know that it's 11 against 1 based on the fact that the judge reiterated what Reddington said that one juror is unwilling to actually

4:21follow the judges' instructions on reasonable doubt. We don't know if they're 11 to 1 on which verdict they're choosing. It's just 11 to 1 on that instruction specifically. So folks, they just sent the jury home. They just went home for the night. Again, they got Friday, Friday before a holiday weekend. Day seven now, they got this case a week ago today, and now they will go to a day seven of deliberations. Please update me on the hour room. I believe I actually heard a very specific deliberation clock time of 36 hours and 22 minutes. You all they are knocking on the door now of some really extraordinary debate, excuse me, deliberation time. So yeah, Roads, we wondered what would happen after the drama. If you heard our last episode, please check it out. But we'll just pick up their roles. We didn't know how long this jury might spend the last 30 minutes to know if they come back and say anything.

5:22And sure enough, they went back in their 30 minutes after all that drama came out and he sent them home. They're back at 9 a.m. However, Roads, that's what he said in court. We just got something else from Kevin Reddington as he was leaving the court. That's right. We just watched a mob basically swarm Kevin Reddington as we expected. We've seen it each day, but today was by far the most. I don't know the largest and the most aggressive journalist crowds surrounding Kevin Reddington refuses to go to podium. He said that before kind of jokingly, I don't do podiums, but this is one where he really needed to stop at a podium. You had actually people falling journalists and whatnot with the cameras. We saw someone look like they were having a medical emergency almost came out of that scrum. Yeah, we had someone first initially say somebody's down. Then we kept hearing people say, ow, it was cameraman reporters, photographers, all getting just actually seemingly hurt in some cases in this scuffle.

6:23And yes, at the end, somebody actually had to go down and look like they were about to faint. That's how crazy the situation was. But we heard Kevin Reddington say that tomorrow at 9 a.m. when the jury comes back, there's going to be something that takes place in open court that we were not expecting. He said there's going to be an inquiry. Now, this is not something the judge said in open court. However, Kevin Reddington was he supposed to say it or not. Don't know, but he has come out. He told you it was the first thing he explained to reporters at 9 a.m. tomorrow when they come back for the jury deliberations, there will be an inquiry. He hopes it will be an open court with this juror in particular said it could be a sidebar, but he hoping it's an open court to deal with this matter. So ropes is not resolved at least according to him. Yeah, and he said the juror has been identified because up until now, look, we watched the judge bring in each juror. Including all the alternates one by one, have them taken oath, ask them a question. We basically understand that the question was something to the effect of, can you follow my instructions?

7:33And if they said yes, under oath, he sent them to be seated. And he did this with every single juror. So we don't know, at least we didn't know which juror is the one who's being accused by the four person of not being willing to follow the judges instructions. But if this particular juror who has, according to Kevin Reddington, been identified, singled out, brought into open court and questioned that that seems like something, I mean, that's something I've never seen before, but it seems unprecedented because now that juror is going to be known by everyone in that courtroom as the juror who is reportedly being unreasonable. I don't know how this works legally, but it seems wrong. This seems wrong. It seems, um, broke, it seems like this person has been pressured. Like a lot of people, depending on where you are on this case, will say you are in favor of this juror because they are holding firm or you annoyed with this juror because they're holding firm for their holding things up.

8:35Well, again, I both ways here, you're annoyed because they're holding firm or you're loving them because they're holding firm. I'm saying for either side, you have a reason, possibly being in favor of this person at this person is now being pressured. It seems here's the instruction again. They're not following your instructions. It seems like justice is only when this person is coerced into changing their mind with the majority is how it feels. It's how it's coming off and it's why people have problem with the dynamite charge because right now, ropes, all the debate and stuff we're hearing on TV are, well, maybe this person just doesn't understand. Well, maybe they're a little slower. I mean, even suggesting not of greater intelligence and this things to be explained to them again, this idea that you just need to get on board with the others and what the others are doing. I don't know obviously what happened in those deliberation room in that deliberation room and we're not supposed to know and we understand that, but I was imagining a scenario for the four person to have to come and pass a note to the judge saying there is a juror who is refusing to follow your instructions on reasonable doubt.

9:45Could this juror have basically said in deliberations, I know what the judge said, but that's not what I'm going to base it on. Did this juror expressed to the other jurors that they realize they're being unreasonable, or they realize that technically they're not following the instructions, but they don't care because they want it the way they wanted. We don't know what that juror said to prompt that note being passed to the judge. Just mistrial time. Prove this is now this, it just feels, and he wants a motion to remove this person. Okay. You put somebody else on that maybe is on your side or is in favor, and now you remove somebody who was fight, who had their belief for whatever it may be and the others, the majority made a determination and no, you're not doing it right. You're not doing it right. So we're gonna go tell on you and possibly get you removed or prove something about that doesn't feel just because if you're that defendant and that one person as a whole that

10:45is gonna keep you out of prison, you'd be pissed that this was going on. So it just depends on what side you're on, but it feels wrong that it just, it feels, I know it's our system and everything that's been done on the up and up and it's legal, but something about like pressure on this person now. It feels like every single legal analyst who we have watched, witness what's happening in that courtroom. No one really knows what to think or say. This is all very highly unusual. This is not something we see very often, but Kevin Reddington says he wants all of it in open court. He doesn't want things inside bar. He wants it to be known in public, but I'm not sure because then someone asked him in that scuffle and that scrum, do you want a mistrial? And he very, very quickly said, why would I want a mistrial? We kicked the shit out of their case. I don't want a mistrial. He was fired up in every way today.

11:46So just a regular day for him. It's what that is for Kevin Reddington. This is extraordinary stuff. So what is it we can expect tomorrow? And what does it mean now? Because we are up against yes, a holiday weekend. Didn't catch the latest role in the Martin unfiltered podcast. Here's what you missed. And the argument is, do you want to win? If you don't win, you have no power. It's real. Those are the very people who I always say vote against their own economic interests, and they complained about the very thing they were seeing. It's wrong. I knew that the issue of transgender athletes was not going well with a lot of black men. Roland Martin unfiltered. I went off. I said, this is exactly what I'm talking about. We are following all of the events inside that courtroom in Massachusetts. And certainly what just happened outside of the courtroom because Kevin Reddington just walked out after a very fiery exchange with the judge in open court. And he claims there is more to come in the morning.

17:52And it's beyond just the jury returning to deliberations when court ended. Yes, we heard the judge say, well, like you back here at 9 AM, where deliberations are going to continue. But we just heard from Reddington that they may not begin those deliberations right away. So yes, we now have something, Robes, already in the morning to look forward to in terms of drama. Every morning, they're just supposed to say, hey, welcome. Go back and deliberate. And we wait. And it just hasn't been the case on any of these mornings. This was one of the, this might be the only one, Robes, that started with them just coming in. Good morning, go deliberate. And they kind of did it on time. And then the day becomes this. Robes, we've seen this plenty of times over our careers. We've seen it even recently. Becoming up against a holiday weekend. What is this group going to do? What plans do they have? Never thought we'd get to this. But does that have an impact on their deliberations now? And Robes, if they remove this juror,

18:52if there's an inquiry like they say, God, forbid this person gets removed. Robes, I have to start deliberating over again. If that's not something they're going to be able to do quickly, what the new person comes on and say, how are you guys voting? You know what? That's how I feel, too. Let's get on out of here. It's not supposed to work that way. What if it does? Will there be a miscarriage of justice? Again, it just is the system, but something feels wrong about that. That let's get the person off this, not with us. And let's get somebody else in here who will vote the way we want. And let's just say this person is not following the judge's instructions. What if that person is convicted? What if they just said something wrong, but it is their conviction, how they want to vote? And that's the way the system is supposed to. I'm supposed to possibly have somebody in there, even if it's one. If they're on my side, then dammit, that's not the way it's supposed to go.

19:53Even if it's one, baby, that is what our system allows. This is fascinating. So what could happen tomorrow? So the juror could remain, the deadlock could continue, and we could end up with a mistrial. The jury, the juror could go back and could finally decide to go ahead and go with the majority, and we get a verdict, or the juror could be removed, and a new juror, one of the alternates, could be put in place, and then deliberations would continue. And then what, if they don't reach a verdict, they could keep deliberating into Tuesday, because obviously they would have the weekend and Monday's Labor Day off. So there are basically four different scenarios that could take place. Is that how many we could be at? Because it really at this point, I wouldn't even dare to guess what could possibly happen tomorrow. I actually thought today, obviously today, we're either going to have a verdict or a mistrial.

20:56Never in my wildest dreams could I have predicted what we actually saw happen and occur today in that courtroom. This is fascinating and look. It was a complicated trial. It was a controversial trial. It was a heartbreaking trial, and it was drama-filled. So why would we expect a short, a quick deliberation? Why would we expect a drama-free deliberation? This is what the country is going through, ropes, seven days of deliberation. That is about right. That's exactly what the country is going through in all of our conversations and all of our back and forth and trying to, I don't know, reconcile how we move forward when all of us have different views. Not just different views, ropes. Diometrically opposed views of what to do with this lady. Yeah. If you ever just want to get a taste of where America is on this, if you watch any of these live feeds, court TV is the one that has the comments rolling, right? I just happen to watch a few of them come through.

21:59It is remarkable how entrenched people are in their beliefs, in their position on what the verdict should be. And I worry, whatever outcome happens in that courtroom, whether we find it out tomorrow or Tuesday, I worry about public reaction to the verdict. I think these jurors have every reason to be concerned about their names, their identities, being released in some way, shape, or form. And certainly this one juror who has now been singled out, we don't know their name, we don't know anything about them, nor should we. But... Obviously there was a fear that that identity would somehow be known or be released. I just, the tension is just so high right now, I'm deeply concerned for people's safety. I mean, look, just even seeing what happened with members of the media trying to get a microphone or a camera close to Kevin Reddington, people were being injured and possibly suffering issues,

23:01medical issues, just trying to get close to Kevin Reddington, that speaks to the intensity and the passion surrounding this case. Keep an eye on it tomorrow, folks. We certainly will be, please keep an eye on our feed. Because, yes, 9 a.m., they're back for deliberations, but there is some business, very serious business to tend to that could have an impact on deliberations moving forward.
