From my perspective as a retired NYPD sergeant, this filing looks less like the discovery of a completely new suspect and more like an attempt to attack the legal process that produced the conviction.That does not mean the court should ignore his allegations.Every defendant is entitled to competent counsel and a constitutionally valid plea.If his attorneys withheld genuinely exculpatory evidence or made materially false representations, the court must investigate that.But a defendant cannot knowingly answer every plea question, obtain the benefit of avoiding death and later erase the agreement simply because he dislikes prison or believes public attention has created a new opportunity.
Kohberger’s credibility is now central.
The judge will have to compare the man who admitted guilt in court with the man who now claims that his innocence is “his truth.”
Courts deal in evidence—not personal truth.
