As Donald Trump and meshes himself in another sex abuse scandal, this one involving Cornell University, his Department of Justice and Todd Planch are desperately trying to extricate himself from the Epstein files and Epstein documents scandal. But they're doing it in completely the wrong way. In the Katie Fang lawsuit, they're pissing off the judge by either not filing what he requires them to file, or filing a document that's not what he has to for. All trying to cover up how the Epstein files, who made the decision to produce or not produce certain documents,

what was the decision making rule about Donald Trump's name, why were predators covered up, why were victims' names released to the public? How did that entire pile of documents get chosen? It was an editorial decision by the Department of Justice, human beings, maybe assisted by artificial intelligence, who knows, who made decisions about which document to put in and how, and what that document would look like, and which documents to leave out. See, that's at the bottom of Katie Fang's lawsuit, not the three million that were produced, but how they were chosen, and which ones were left behind on the cutting room floor. That's for hopefully a special master appointed by Judge Sullivan for that person to determine. Was it done properly in the look back in the audit of the documents already produced? What about the documents that weren't produced? Why weren't they produced and should they have been produced? Those are the questions at bottom of Katie Fang's lawsuit. In the last couple of days, the Department of Justice and Todd Blanche

have basically told Katie Fang to go pound sand when they're not attacking her or her lawyers personally, they're attacking the judge. Here, instead of filing what they were supposed to file on the first of October, they filed a motion for leave to postpone a deadline on the day that it was due. What was due? What was due was the administrative record. I'm going to sort it out for you right now. What other deadline they missed and catch you up and tie it into the Cornell rape investigation. Because Donald Trump has made that a new issue for him with less than 30 days to go to the midterm election with voting already starting. You're on legal AF YouTube to kick off our Monday. No, I'm going to be meeting with Danny Bensky and the survivors of the Epstein attack and predator behavior with a at a press conference that they're going to be conducting in Manhattan about the Epstein reading room, making it front and center of this election.

Of course, Donald Trump has has made it in the top of mind of people and voters because of his reaction to the Cornell investigation, having been triggered by the appointment of Latisha James as the attorney general as the special prosecutor. She's the New York attorney general. Let's talk about what just got filed and what got missed. What is the administrative record? No matter Katie Fangs lawsuit is yes about the Epstein file transparency act, but it's about the administrative procedures act. A 50 year old set of statutes and laws, which govern how agencies operate and operate transparent transparently. If you are going under the administrative procedures act arguing that there's a final agency action or some agency is acted arbitrary and capriciously, that's a term of art in APA law. Then you do what Katie Fang has done. You bring the lawsuit and you say there was a final agency action. And what was that as it relates the Epstein file transparency act?

That was the final decision to say we've produced everything. Final agency action that triggered administrative procedures act remedies and somebody like Katie Fang with informational injury as a reporter bringing the lawsuit. Now the DDoJ doesn't want to respect her Katie Fang as someone who has standing or an ability a ticket to the courthouse to bring the suit. So they argue that she doesn't and they're still arguing that even though the court has already found under the preliminary injunction procedure that she has standing has not been reversed on appeal. So they keep arguing she doesn't have standing as an excuse on the day it is due picture yourself in college or high school your your report is due your class report is due and you come in with my dog eight the Epstein file submission. Professor teacher I know it's due today, but here's a motion to postpone the deadline of that I filed on the day was due.

How's that going to go over same way with your high school teacher or your college professor with judge Sullivan not well not well. He's already issued his order as I expected him to do. He wants to hear he likes to have the parties do the heavy lifting. So he has ordered that Katie Fang side and I know they're going to do it gladly to file on the plaintiff shall file their response. So in two days on Wednesday the Katie Fang side needs to file their response to the motion for leave to postpone the deadline to get the administrative record we'll talk about the substance of that in a minute. And then the defendant has until the 13th to file its piece of paper and then the judge will rule. The administrative record when it comes to this decision about what goes in the pile and what gets left out is exactly that it would be the emails the correspondence the training video if there was one the protocol videos the protocol memos when people had questions if they communicated they weren't all in the same room with the same time.

If they communicated with their superiors or their fellow reviewers we need that as well everything that went into the decision to declare that this is the final final Epstein production that's the administrative record under administrative procedures act and then from there Katie can amend her lawsuit to argue arbitrary and capricious procedures things are missing we need a special master and the rest which is really at the core at the heart of the loss of the lawsuit and filing at the last minute we never did it she's not entitled to it and then I love this there's nothing in the administrative record that would be helpful. They say on page three and we'll post this on legal AF sub stack finally the court any other document the court or a party might wish to rely on this case has already been published in the Epstein library specifically the FBI vault under records regarding the review of the record. It's regarding the review of the investigative holdings related to Jeffrey Epstein contains emails and records evencing how documents now hosted on the library were collected reviewed and redacted for publication.

Really where's the emails where's the video where is the rest of it they want to make Katie fang a freedom of information act for you plaintiff even under FOIA they would get everything so their whole argument. Collapses under its own weight and speaking of waiting why are we still waiting around for them to file a required notice of compliance that the judge ordered a month ago he reminded them yesterday that they failed to file yet this is like the fifth time that missed a deadline in this courtroom they have failed to file a notice of compliance because they submitted. The hand written FBI interview notes of the victim who claims that she was victimized by Donald Trump when she was 13 years old it's about 40 or 50 pages worth of notes but they didn't want that out in the public that way so they sent a creepy sneaky email apparently to the lawyers for Katie fang and to the and to the public integrity project lawyers for Katie and to Katie.

And to Katie and told the court that they submitted it and submitted it to the court but didn't tell the public see you're supposed to put that on the public docket the public docket is supposed to be transparent so the public knows what's going on. Public integrity project has a point where is the filing the notice of compliance so he gave them until noon today to file a document that list by baits the missing documents that were submitted to the court to announce to the world that they submitted the report. The Epstein interview notes or the Epstein interview notes of the victim who claims that Donald Trump of you sir 13 he wants that on the public record not because Katie fang reports on it or legal a reports on it the docket should be complete and a complete recitation and chronological order of events in the case that's what it's all about and most documents and all documents unless they're redacted to protect the victims names for instance they are all available.

They're all they're not sealed they are available for a reason because we do our justice in public somebody is accused in public if it's a crime through a public indictment somebody is able to clear their name and every event in between all in public. So we got some events coming up later today and I'll report on it they're going to have to file their notice to the public that they gave the 50 pages of FBI handwritten interview notes over to the judge we can have a go and we'll see how that plays out they certainly we know why they didn't want it on the public record especially less than 30 days to the midterm election at the same time Donald Trump. While they're trying to cover them up in the Epstein scandal in the tape brothers scandal he's busy going after and protecting the the assailants the alleged rapists in Cornell the seven fret brothers get Donald Trump's love not the victim not the survivor that must not have gone over well I don't think inside of the White House and the Department of Justice.

You know they must feel like what's that story when I was a kid the little boy at the dyke with all the with all the water coming through and he's trying to plug it up put his finger here put his finger there you know they only got 10 fingers.
