You know how they said that gamers don't own their digital purchases and that by saying, you know, buy now. Everybody understands that to me. You're not actually buying your game. I mean, that's the dumbest defense I've ever heard. And now a consumer rights wiki has collected all of Sony's ownership claims over the years. And there's like 44 or 50 of these claims that were Sony explicitly says if you purchase a digital game, you own it.

1:04Yeah, they have a bunch of examples of where they said that, you know, you bought or owned the game. Yeah, and they're trying to argue that no, no, no, guys, that just means rent. It means lease your game. Everybody knows that buy it now means it's understood. These are still understands. And this, this is one of their key defenses in the class action lawsuit that they're trying to argue that everybody knows buying a game doesn't mean you actually bought the game. You silly, silly people. Yeah. So let's talk about this. Let's take a look at some of this evidence here. And this is not going to go well for them in court. A consumer rights wiki has collected Sony's ownership claims from support pages, store listings and official blog posts. So they said the collection spans PlayStation support pages store listings blog posts with live links archive snapshots and highlighted screen shots showing exactly where Sony uses ownership language. So this is on the consumer rights wiki. So here we have paragraph 56 of the complaint states playstation software, a proch license agreement expressly provide software license to you not sold. This is their their defense in court. The license agreement. This is Sony saying this the license agreement expressly provides that the software is licensed to you and not sold. And you go down here and language such as buy now and confirm purchase to induce consumers to complete the transaction.

3:08Don't actually mean you know, buy it now. This is the license you not sold. So this is all the language in the lawsuit, right? So you go down you go down the head different examples. Yeah, highlighted in red and stuff. So yeah, I just wanted to give some background information for those of you who aren't aware of this this class action lawsuit that they kept trying to argue you don't own your games that stupid. We've never told you that your own your games your imagining things and they are gaslighting consumers because on several occasions they have said the opposite. So this is this is an add on content requires a game Sony argues buyers do not own they said upgrade an eligible PS4 digital game on the PS5 console with a disk driver PS5 digital edition console to upgrade an eligible digital PS4 game you already own to the digital PS5 version. You already license it says you own you own then below it they have it goes down here it is talking about the third step if the game is owned by someone else who shares the console make sure they have a

4:13console sharing an offline play. Yeah, so how can how can you do that if you don't own your game on the game right. Sony's previous communications also refer to ownership and emails sent the users on May 29th of 2021 titled important changes for PS3 PS Vita and PSP platform. This is going to come up in court and it's not going to go well for them Sony is saying that all owners of which are three of access to two DLCs at no additional cost. Yeah owners well jeez golly where would I get the crazy idea that I own my digital games unless you've been telling me for years that I own my digital games Sony. What they said here to they're talking about Sony identified the FAQs about troubleshooting games and the PlayStation store and they said lock games on your PS5 console they were purely for to it as a purchased those purchased the game and who own the license and the context of reading the game licenses on and purchased not rented.

7:37Yeah to verify you have the license for the content follow follow the steps below make sure you're signed into the correct account check your transaction history make sure the purchase was successful the game is owned by somebody else yeah make sure they have console sharing on so this is this is how they're they're treating it loss is basically Sony is definitely gaslighting consumers and they're lying in the. They can play are their defense right because the complaint was it was a lawsuit against them but they're they're lying so now they're saying the PlayStation software license has this patch on it that it's a license to not sold but there's enough screenshots and examples but we did that where they referred to it as purchasing owning. Yeah so let's take a look this is how they i'm going to zoom in on this so people can see in the lawsuit Sony argues reasonable consumers would not believe they were obtaining ownership of a digital game and Sony's terms and support pages Sony's upgrade and support page refers to an eligible digital PS4 game you own.

8:38In the lawsuit Sony's terms of service told users they do not own the product obtain through the store and Sony say the license clause the software license to you the clause yeah Sony software license defines that software to include downloadable content and its PlayStation plus help says a buyer who loses game will lose all access to the DLC and add on content associated until they resubscriber decide to purchase. You can purchase the title lots and possibly can't purchase games right so how you supposed to do because you can't buy you can you can purchase you don't want to purchase the license you just want to own it but still you guys are going to be really. Hard press on some of this because you have so many examples previous examples where you referred to it as ownership. Yeah so this is a pretty recent update as I understand it Sony's PlayStation software license folds patches updates and downloadable content into the license software and section 1.4 states software is licensed to you not sold. That's that's bullshit that's a cop out you've been telling people for years they were purchasing digital games then you need to get rid of.

9:44The buy now button and it just needs to say like unlock for limited time only. This is Sony's cancellation policy sets refund eligibility for in game consumables by when they are purchased consumables bought in the PlayStation store outside the game player delivered to you when you launch the game during gameplay deliver immediately etc etc cannot be canceled must faulty. It goes on and on and on there's so many. Look at these look at all these. To view broadcast for game you own to the games hub to upgrade an eligible digital game you own to the PS VR to version. Yeah I think they're going to be a little side with the consumer right so. This is going to be really interesting to see how this goes down I think it's going to be another class action settlement and they'll be like okay everybody gets we're going to have a 30% off sale for limited time.

13:03On on leaseable games. It's like or they'll make yeah it's like oh my god they said there's also Sony's explanation if it's PlayStation store rating system just last year they said you have to own it goes on and on and on. I said for now Sony is seeking individual arbitration citing terms it says all four planets accepted without opting out. It has alternatively requested dismissal with a hearing schedule for October 1st whether the wiki's collection influences proceedings remains to be seen. I think I think it will because I think now because now the plaintiffs can point to this and even if the judge the jury or whoever the hell is arbitrating this doesn't understand how it works here are 44 examples where you tell somebody they they own their game they can access their game even after it's going offline even after we stop making the consoles. They can still access games they purchased and now you're your backpettling and saying no you're no we never promised you a purchase we can take it away whenever we want to and it's like I'll go well for them I don't think.
